Hawaii is one of the 13 US states with has anti-discrimination laws protecting lesbian and gays. In Hawaii the legislation covers employment, public and private housing and union practices.
In 1993, the Hawaii Supreme Court ruled that denying same-sex couples the freedom to marry constitutes discrimination on the basis of sex under the Hawaii Constitution, and ordered a trial to permit the state to try to demonstrate a compelling reason to limit civil marriage to different-sex couples. After trial, Judge Kevin Chang found in December 1996 that the state had failed to show a single valid reason for excluding same-sex couples from marriage. Subsequently radical right-wing groups pushed an amendment to the state constitution, which gave the legislature power to discriminate in marriage regardless of the constitutional requirements of equality. On the basis of the amendment, the Hawaii Supreme Court dismissed the case in December 1999.
